Terms of Service — GapPlate

1. Acceptance of These Terms

By downloading, installing, or using the GapPlate mobile application (“the App,” “we,” “us,” or “our”), you (“you,” “the user”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not download, install, or use the App.

If you are using the App on behalf of a minor, or if you are yourself a minor in your jurisdiction, please see Section 3 (Eligibility) below.

2. Description of the Service

GapPlate is a nutrition-tracking application that allows you to:

  • Log foods and meals you consume, and track nutrient intake over time
  • Access a library of foods and nutrients, personalized to dietary restrictions and other profile information you provide
  • Optionally connect your own Google Gemini API key to unlock AI-assisted features, including adding new foods and nutrients, personalized recommendations, and conversational nutrition guidance
  • Back up and restore your data to files under your control

The App can be used without an API key (“Simple” tier) or with your own API key (“Power User” tier), as described in the App itself. GapPlate is available for Android and iOS; some features, screens, or wording may differ slightly between platforms.

3. Eligibility

You must be at least 18 years old to use this App. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement and consent of a parent or legal guardian.

The App is not directed at children, and we do not knowingly collect information from children under the applicable minimum age.

4. Not Medical Advice

This is important, and it governs your use of the entire App.

GapPlate provides general nutrition information and tracking tools. Nothing in the App — including AI-generated content, nutrient recommendations, food descriptions, “meal advice,” or any other feature — constitutes medical advice, a medical diagnosis, or a substitute for professional medical or dietetic advice.

You should consult a qualified physician, registered dietitian, or other healthcare professional before making changes to your diet, especially if you have an existing health condition, are pregnant or breastfeeding, are managing a diagnosed medical condition, or are taking medication that interacts with diet. Do not disregard, delay, or discontinue medical treatment because of anything you read or are shown in this App.

Do not change your food intake or diet based on the measurements, targets, or recommendations shown in the App — whether those come from tracked data, nutrient calculations, or AI-generated advice. These are informational tools, not personalized medical guidance. Consult a registered dietitian or doctor before making any changes to what or how you eat.

5. AI-Generated Content

Many features in the App — including food details, nutrient information, recommended daily intakes, recipe suggestions, and personalized guidance — are generated using artificial intelligence (currently, Google’s Gemini models) based on prompts constructed from your profile and the food or nutrient in question.

AI-generated content may be inaccurate, incomplete, or occasionally wrong. While the App is designed to encourage the AI to be careful and evidence-based, we do not independently verify each individual piece of AI-generated nutritional data before it is shown to you. You are responsible for using your own judgment, and consulting a professional where appropriate, before relying on this information — particularly for any decision with health, allergy, or safety implications (for example, whether a food is safe given an allergy or medical condition).

Check new data before relying on it. When a food or nutrient is newly added — whether by you, or automatically from the App’s built-in library — review its details before using it to make decisions. If any value looks wrong, doesn’t match the product you actually have, or doesn’t reflect your own situation, edit it yourself. The App lets you correct any field at any time; AI-generated defaults are a starting point, not a guarantee.

Data can become outdated. Foods and nutrients already in your own library are not automatically refreshed as AI models and nutrition data improve over time. If you have added your own API key, use AI Prefill on an existing food or nutrient to pull a fresh lookup — useful periodically, or whenever you want to check whether anything has changed since the App was installed or since you last refreshed that item.

6. Your Own API Key and Third-Party Services

If you choose to use Power User features, you must supply your own Google Gemini API key, obtained directly from Google. By doing so:

  • You enter into a separate relationship directly with Google, governed by Google’s own terms of service and pricing, entirely independent of us
  • You are solely responsible for all costs, quota usage, and billing associated with your API key
  • We do not have visibility into, and are not responsible for, Google’s service availability, pricing changes, rate limits, or the accuracy of Google’s AI model outputs
  • Your API key is stored locally on your device and is not transmitted to us or any server we control

We are not affiliated with, and this App is not endorsed by, Google.

If you install the App via Apple’s App Store or TestFlight, your use is also subject to Apple’s own Media Services Terms and Conditions and, for beta versions, Apple’s TestFlight terms. We are not affiliated with, and this App is not endorsed by, Apple.

7. Beta and Pre-Release Versions

If you are using a version of the App distributed through TestFlight, or otherwise labeled as a beta, preview, or pre-release version, you acknowledge that:

  • The App may be less stable than a full release, and may contain bugs, incomplete features, or unexpected behavior
  • Data (including diary entries, foods, and nutrients you add) may not carry over reliably between beta versions, and could be lost during testing
  • Features, screens, and wording may change before the App’s full release, without notice
  • Beta access may be limited, time-boxed, or withdrawn at any time

Beta testing is provided for feedback purposes and should not be relied upon for ongoing, uninterrupted use.

8. Your Data

GapPlate stores your food, nutrient, and diary data locally on your device. We do not operate a server that stores your personal data. Backup files you create are stored wherever you choose to save them (e.g., your device’s Downloads folder) and are your responsibility to keep secure.

9. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract the App’s source code except as permitted by law
  • Use the App to generate, store, or distribute content that is unlawful, harmful, or infringes another person’s rights
  • Interfere with or disrupt the App’s functionality or attempt to gain unauthorized access to any part of it

10. Intellectual Property

The App itself — including its design, code, and branding — is owned by the GapPlate developer and protected by applicable intellectual property laws. Your own data (foods you log, entries you create) remains yours. AI-generated content is provided for your personal use within the App.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, the GapPlate developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of data, loss of profits, or personal injury, arising from your use of or inability to use the App, including reliance on AI-generated nutritional information.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will make reasonable efforts to notify you (for example, via an in-app notice). Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

14. Termination

You may stop using the App at any time by uninstalling it. We reserve the right to suspend or discontinue the App, in whole or in part, at any time.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles.
